Terms of Service

§ 1 Scope, Provider
These Terms of Service apply to all contracts between the provider Yahya Fetaiti, OCTAVIR, Hauptstraße 58, 85579 Neubiberg, Germany (hereinafter "the provider" or "we") and its customers via the octavir.com platform.
A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). Conflicting terms of the customer are not recognized.
§ 2 Contract Formation
The display of products in the online shop does not constitute a legally binding offer but an invitation to place an order. By clicking the order button, the customer places a binding order for the goods contained in the cart.
We confirm receipt of your order immediately by email. This automatic acknowledgement of receipt does not yet constitute acceptance of the contract. The purchase contract is concluded upon our shipping confirmation or delivery of the goods.
§ 3 Prices & Shipping Costs
All prices stated are final prices in euros. Due to the small business regulation under § 19 of the German VAT Act (UStG), no VAT is charged.
OCTAVIR offers free shipping within Germany and to all member states of the European Union. For orders to countries outside the EU, shipping costs are calculated at checkout. Any customs duties, import charges or local taxes for shipments outside the EU are borne by the customer.
§ 4 Payment Terms
Payment options are displayed during the order process (Shop Pay, PayPal, Apple Pay, Google Pay, credit card). The purchase price is due immediately upon conclusion of the contract. For pre-orders, payment is made at the time of ordering; delivery follows in the stated estimated dispatch window.
§ 5 Delivery
Delivery is made to the delivery address provided by the customer. Delivery times are shown in the respective product description and during the order process.
Part of the range is offered as a pre-order. For pre-orders, the stated dispatch windows are estimates and not bindingly guaranteed delivery dates. If the estimated dispatch window shifts significantly, we will inform the customer. The consumer's statutory right of withdrawal remains unaffected.
§ 6 Retention of Title
The goods remain our property until full payment has been made.
§ 7 Right of Withdrawal
Consumers have a right of withdrawal. Details can be found in our separate Withdrawal Policy.
§ 8 Statutory Rights in Case of Defects
The statutory provisions on the buyer's rights in the event of defects apply (§§ 434 et seq. BGB). OCTAVIR does not assume any voluntary guarantee or warranty in addition to these statutory rights, unless expressly agreed in writing in an individual case. Any manufacturer's guarantee remains unaffected.
The limitation period for claims arising from defects in new goods is two years from delivery of the goods to the consumer.
In the event of a defect, the consumer may, at their choice, request subsequent performance in the form of repair or replacement. If the legal requirements are met, the consumer may also reduce the purchase price, withdraw from the contract, or claim damages in accordance with the statutory provisions.
§ 9 Liability
We are liable without limitation for damages arising from injury to life, body or health, and for other damages based on grossly negligent or intentional breach of duty. Otherwise, liability for slightly negligent damages is excluded, unless essential contractual obligations are breached.
§ 10 Product Notice
OCTAVIR sells strap and adapter systems exclusively as independent aftermarket accessories. Watches are not included.
Watches shown on the website are for visualization and compatibility purposes only and are not part of the purchase contract.
Minor colour and material variations between the product display and the actual goods may occur and do not constitute a defect (lighting conditions, screen settings, material batches, coating processes, anodizing, brushing direction, manufacturing tolerances).
§ 11 Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. Our email address is info@octavir.com.
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions be invalid, the remainder of the contract shall remain effective.
